What is Workers Compensation?

Probably one of the first questions we should answer when we discus worker’s compensation is just what is Worker’s Compensation?

Worker’s Compensation is an area of law that’s distinct from other areas of law. It’s a separate court system from what we traditionally think of as a court system. It’s not a circuit court system so it is not in the same court system.
For example when you get a traffic ticket and you go to court, it’s completely separate.

Workers Compensation runs out of the Illinois Worker’s Compensation commission which is in downtown Chicago with some other area sites. Each county generally also has a site which holds hearings and other events really that’s Worker’s Compensation cases.

Also generally speaking, workers compensation is an area of law designed to protect both the employee and the employer.  It protects the employee for example when an employee is hurt.  It gives you certain benefits that you are entitled to if you are injured at work as a result of a work accident. It also protects the employer in that it separates the legal system so that you are not able to be sued in civil court saving you any damages and fees from defending the case.
