What does a title company do? We answer

Hi, I am Mark Saladin, I am one of the partners here at Zanck, Coen, Wright & Saladin in Crystal Lake Illinois and I’ve been a practicing attorney for over 30 years, most of them right at this firm. Today we are going to talk about common real estate questions.

In a residential real estate transaction, it’s important to have a title company involved because first of all on the seller’s part we have to make sure that the title to the property is in the proper names, that there is no surprises, that there aren’t any liens or judgments or any types of encumbrances that could affect the title and if there are we need to take the appropriate steps to help clear them prior to closing.

The title company is an insurance company and basically what they do is they will protect the buyer and the lender in a transaction for purposes of making sure that anything that happens from the day of closing and back in time so that they know that if some claim comes up from some third party 20 years ago that they say hey, that’s our property, we have a deed to that property, the title company will defend you as a buyer with respect to any such claims.
